Abide by the Federal Trade Commission’s Fair Credit Reporting Act (FCRA), 15 U. S. C. § 1661 et seq. and the following state ruling:

Massachusetts - M.G.L. Chapter 93, Section 52 –
Information not to be contained in report; exceptions (a) Except as authorized under subsection (b) no consumer reporting agency shall make any consumer report containing any of the following items of information: (5) Records of arrest, indictment, or conviction of crime which, from date of disposition, release, or parole, antedate the report by more than seven years. (b) The provisions of subsection (a) are not applicable in the case of any consumer credit report to be used in connection with: (3) The employment of any individual at an annual salary which equals, or which may reasonable be expected to equal $20,000 or more.

Unlawful practices It shall be unlawful practice: (9) For an employer, himself or through his agent, in connection with an application for employment, or the terms, conditions, or privileges of employment, or the transfer, promotion, bonding, or discharge of any person, or in any other matter relating to the employment of any person, to request any information, to make or keep a record of such information, to use any form of application or application blank which requests such information, or to exclude, limit or otherwise discriminate against any person by reason of his or her failure to furnish such information through a written application or oral inquiry or otherwise regarding: (i) an arrest, detention, or disposition regarding any violation of law in which no conviction resulted, or (ii) and arrest, first conviction for any of the following misdemeanors: drunkenness, simple assault, speeding, minor traffic violation, affray, or disturbance of the peace, or (iii) any conviction of a misdemeanor where the date of such conviction or the completion of any period of incarceration resulting there from, whichever date is later, occurred five of more years prior to the date of such application for employment or such request for information, unless such person has been convicted of any offense within five years immediately preceding the date of such application for employment or such request for information.

Motor Vehicle Record Search Requirements by the State of Massachusetts

Motor Vehicle Report is sometimes referred to as a MVR, MVR Report, MVR Search, MVR Check, a Driver's License Verification, a Driving Records search, or a DMV search. The Massachusetts Motor Vehicle Report checks the driving record of a potential employee and verifies that an applicant has the driver's license claimed. It may provide information regarding irresponsible behavior, including whether there is a history of substance abuse, repeated traffic violations, failures to appear, and unpaid fines

Massachusetts Departments of Motor Vehicles (DMV’s) maintain and provide driving records in one way or another. Massachusetts Motor Vehicle Records (MVR’s) report the applicants’ statewide driving records, including Commercial Driver's License status (CDL) for at least 3 years, oftentimes up to 7 years. It is logical to screen Massachusetts motor vehicle records for any employment position requiring driving, such as trucking, transportation, delivery, DOT compliance or any use of company vehicles. However the MVR provides additional valuable insight into the character of the applicant regardless of the position being filled. Most importantly, the Massachusetts MVR is the only source for a verified date-of-birth which is critical for an accurate criminal record search. Massachusetts County court criminal records are filled by name and date-of-birth, not by SSN! Motor Vehicle Reports provide a wealth of personal data that can be used for cross-reference, and criminal offenses pertaining to motor vehicles which may not be revealed by other criminal checks.

Massachusetts driving record (MA)

All Massachusetts residents need to obtain a valid Massachusetts license in order to operate a motor vehicle in Massachusetts. Anyone who is a Massachusetts resident, is at least 16 years old, and has not had a driver's license or the right to operate revoked may apply to begin the process of obtaining a Class D or Class M License at any full-service RMV Branch. Records are available for 6 years plus current year for moving violations. It takes 1 week before new records are available for inquiry.
