State FCRA Rulings

Abide by the Federal Trade Commission’s Fair Credit Reporting Act (FCRA), 15 U. S. C. § 1661 et seq. and the following state ruling:

Minnesota Statutes 2007 13c.02 subdivision 2
Form; copy The disclosure required under subdivision 1 must be in writing and must be provided to the consumer before the consumer report is obtained or caused to be prepared. If a written application is provided for employment purposes by an employer or prospective employer, the disclosure must be included in or accompany the application. The disclosure must include a box that the person may check off and return to receive a copy of the consumer report. If the consumer requests a copy of the report, the person requesting the report shall request the person preparing the report to provide a copy to the consumer. The report must be sent to the consumer by the person preparing the report within 24 hours of providing it to the person requesting the report. The report to the consumer must include a statement of the consumer’s right to dispute and correct any errors and of the procedures under United States Code, title 15, sections 1681 to 1681t. A consumer may not be charged for a report provided under this section. If no report exists, the consumer reporting agency has no obligation to the consumer under this section.

Minnesota Departments of Motor Vehicles (DMV’s) maintain and provide driving records in one way or another. Minnesota Motor Vehicle Records (MVR’s) report the applicants’ statewide driving records, including Commercial Driver's License status (CDL) for at least 3 years, oftentimes up to 7 years. It is logical to screen Minnesota motor vehicle records for any employment position requiring driving, such as trucking, transportation, delivery, DOT compliance or any use of company vehicles. However the MVR provides additional valuable insight into the character of the applicant regardless of the position being filled. Minnesota driving record (MN)

Anyone who drives a motor vehicle on public streets or highways in Minnesota must carry a valid and unexpired driver's license. If you have never had a driver's license in any state or country, you must pass a knowledge test and a vision test, apply for an instruction permit, and pass a road test. If your Minnesota driver's license has been expired for more than one year, but less than five years, you must pass a knowledge test and a vision test before applying for a new license.

If you are moving to Minnesota from another state, certain U.S. territories, or Canada, you can obtain a license by passing the knowledge and vision tests. You have up to 60 days after becoming a resident to obtain your regular Minnesota license or permit; with a commercial license, up to 30 days. You must also present a valid driver's license, or one expired for less than one year, from your former home state. (See Identification Requirements) If you have a motorcycle endorsement on your out-of-state license, you can obtain a Minnesota endorsement by passing a test and paying the appropriate fees.

Records are available for 5 years minimum for moving violations and suspensions; 10 years for open revocation; retained indefinitely for DWIs for 2 or more convictions. Accidents and up to 10 mph over in a 55 mph zone on interstate roads are not shown. It takes no more than 15 days before new records are available for inquiry
