Texas FCRA Rulings
Abide by the Federal Trade Commission’s Fair Credit Reporting Act (FCRA), 15 U. S. C. § 1661 et seq. and the following state ruling:
Consolidated Laws Article 25 Section 380-j – Prohibited information Prohibited information.
(a) No consumer reporting agency shall report or maintain in the file on a consumer, information: (1) relative to an arrest or a criminal charge unless there has been a criminal conviction for such offense, or unless such charges are still pending. (f) (1) Except as authorized under paragraph two of this subdivision, no consumer reporting agency may make any consumer report containing any of the following items of information. (V) Records of conviction of crime which, from date of disposition, release, or parole, antedate the report by more than seven years. (2) The provisions of this subdivision shall not apply to: (iii) The employment of any individual at an annual salary which equals, or which may reasonable be expected to equal $25,000 or more.
Motor Vehicle Record Search Requirements by the State of Texas

Texas Departments of Motor Vehicles (DMV’s) maintain and provide driving records in one way or another. Texas Motor Vehicle Records (MVR’s) report the applicants’ statewide driving records, including Commercial Driver's License status (CDL) for at least 3 years, oftentimes up to 7 years. It is logical to screen Texas motor vehicle records for any employment position requiring driving, such as trucking, transportation, delivery, DOT compliance or any use of company vehicles. However the MVR provides additional valuable insight into the character of the applicant regardless of the position being filled. Most importantly, the Texas MVR is the only source for a verified date-of-birth which is critical for an accurate criminal record search. Texas County court criminal records are filled by name and date-of-birth, not by SSN! Records are availed for 5 years in the state of Texas for moving violations and suspensions, indefinite for DWIs, 11 years for SR judgments. Non-moving violations do not appear on the record. It takes 30 days before new records are available for inquiry.
